We do not sell your personal information. We do not share your personal information with advertisers or data brokers. We do not use your messages or photos to train artificial intelligence or recommendation models. We share data only with the service providers listed in §6 below.
1Who we are
DivorceAve ("DivorceAve," "we," "us") is operated by Emooze, LLC (Emooze), mailing address United States (mailing address pending entity formation). All privacy, security, and general questions are routed to info@divorceave.com while the company is in formation.
2Scope and US-only service
DivorceAve is offered only to residents of the United States who are 18 or older. We do not knowingly accept members from outside the US. If you are not a US resident, please do not use the service.
3Information we collect
3.1 Information you provide
- Account & profile: mobile phone number, optional email, display name, date of birth, gender, photos, city/state, height, eye/hair color, work field, relationship goal, bio.
- Sensitive profile fields (optional): political preference, gender identity, content of your bio that may reveal sexuality or religious beliefs, music/food preferences. We treat these as sensitive personal information and do not require them.
- Messages: the messages you send and receive on the platform.
- Reports & feedback: reports you file about other members, support requests.
3.2 Information we automatically collect
- Device & technical: IP address, user-agent string, device type, time zone.
- Approximate location inferred from IP: country and (where possible) state. Used to enforce US-only access and to flag VPN or non-US sign-ins. We do not collect precise GPS location.
- Activity: log-in events, profiles you view, members you message, block, or report.
- Verification artifacts: phone-verification attempts and results.
3.3 Information we collect from third parties
- Payment status: we receive subscription status and billing dates from Stripe. We never see or store your full payment card number.
- SMS delivery status: we receive delivery results from Twilio for verification messages.
4Sensitive personal information
Some information you provide may be considered "sensitive personal information" under state privacy laws. This includes information revealing political opinions, sexual orientation, religious beliefs, and content of communications.
We use sensitive information only to operate the dating service you signed up for — for example, to show you matches with similar political preferences if you have opted to filter on that field. We do not use sensitive information to make decisions that produce legal or similarly significant effects, and we do not share it with third parties for any purpose other than operating the service.
California residents and residents of states with similar rights may request that we limit our use of sensitive personal information by emailing info@divorceave.com.
5Why we collect it (purposes)
- Service delivery: operate matchmaking, messaging, profile display.
- Account verification: verify you are a real, US-based human via phone and IP.
- Fraud and abuse prevention: detect bots, scammers, ban evaders, and repeat policy violators.
- Safety and moderation: review reports, screen photos, enforce community guidelines.
- Payments and subscriptions: via our payment processor.
- Legal compliance and disputes: respond to lawful requests, defend against claims, comply with consumer-protection laws.
- Service communications: verification codes, trial-ending reminders, security alerts.
We do not use your messages, photos, or profile content to train machine-learning models, build interest profiles for advertising, or for any purpose outside of operating the service.
6Who we share it with (sub-processors)
We share the minimum data necessary with the providers listed below. Each is bound by contract to use it only to operate their service for us. We update this list when we change vendors.
- Stripe — payment processing. stripe.com/privacy

- Vercel — hosting and blob storage. vercel.com/legal/privacy-policy
- Photo-moderation vendor — to be selected (Hive, AWS Rekognition, or similar) before we exceed the volume our human review team can handle. Updated here when selected.
- Age-verification vendor — optional. If we choose to require government-ID or selfie-based age verification for any account, the vendor and its privacy policy will be listed here before we collect any ID artifacts.
We may also disclose information to comply with valid legal process (subpoenas, court orders, search warrants) or to prevent imminent harm. When permitted by law, we will notify you before responding.
7Your rights
Depending on the state you live in, you may have the right to:
- Know what personal information we have about you.
- Receive a copy of your personal information.
- Correct inaccurate personal information.
- Delete your personal information.
- Opt out of the sale or sharing of your personal information (we don't do either).
- Opt out of profiling that has legal or significant effects (we don't do this).
- Limit our use of sensitive personal information.
- Not be discriminated against for exercising any of these rights.
- Appeal a denial of any request.
To exercise any right, email info@divorceave.com or use the Delete My Account button in Settings. We respond within 45 days. California residents may designate an authorized agent to make requests on their behalf.
8Phone verification and IP checks
We verify every member by US mobile phone number. We also collect your IP address at sign-in to infer approximate country and state for fraud prevention and US-only enforcement. IP-based location is an estimate and can be inaccurate (e.g. on VPNs). Access may be limited based on verification results; you may be asked for additional proof if our systems cannot confirm eligibility. These checks are operational and are not a guarantee of physical location.
9Age verification
DivorceAve is strictly 18+. At signup, you must affirm under penalty of account termination that you are 18 or older.
We may offer or require stronger age verification using a third-party vendor (such as government-ID matching or selfie/video age estimation) for some users or some features. When we use a vendor:
- The vendor processes ID artifacts under its own privacy policy linked in §6.
- We retain the verification result (pass/fail and method) but not the underlying ID image.
- You can request deletion of any retained verification artifacts at any time.
10Data retention
We retain personal information only as long as needed to operate the service, maintain safety and security, comply with law, and resolve disputes. Our current schedule:

When you delete your account, your profile and approved photos are removed from public view immediately. PII is wiped within the window above. A minimal tombstone record (phone hash, ban status, account opening date) is kept so banned users cannot create new accounts.
11Security (NY SHIELD Act §899-bb)
We maintain a security program with administrative, technical, and physical safeguards reasonable in light of our size and the sensitivity of the data we handle. The program includes:
- Administrative: a designated security owner (info@divorceave.com), periodic risk assessments, employee training, vendor due diligence, written incident-response plan.
- Technical: encryption in transit (HTTPS/TLS) and at rest, multi-factor authentication for staff, least-privilege access, audit logging of administrative actions, secret management, vulnerability scanning, automated patching, off-site encrypted backups.
- Physical: our cloud providers (Vercel and our database host) maintain SOC 2-audited physical-security controls for the data centers where your information is stored.
If we experience a security breach affecting your personal information, we will notify you as required by NY General Business Law §899-aa and the corresponding laws of your state.
12Children
DivorceAve is strictly 18+. We do not knowingly collect information from anyone under 18. If you believe a minor is using the service, contact us immediately at info@divorceave.com. We will investigate and, if confirmed, delete the account.
13Bans and safety notices
We may warn or notify members about safety concerns — including, where permitted by New York Gen. Bus. Law and similar laws, that a member they have matched with was previously banned from DivorceAve for violating our community standards. Such notices are factual and limited; we do not disclose disciplinary details.
14Changes to this policy
We will post material changes here and notify you in-app and by SMS at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
